TERMS OF SERVICE
Effective Date: April 15, 2025
These Terms of Service (“Agreement”) govern access to and use of the Human Behavior platform (the “Service”), provided by Make Dough Inc., a Delaware C Corporation (“Provider”), by the customer entity agreeing to these terms (“Customer”).
By executing an Order Form or otherwise accessing the Service, Customer agrees to be bound by this Agreement. If you are entering into this Agreement on behalf of an entity, you represent that you have authority to bind that entity.
Provider offers an AI-powered platform that analyzes digital session replays, including user interactions, metadata, and behavioral signals, for the purpose of deriving product insights and performance metrics.
Subject to payment and compliance, Provider grants Customer a limited, non-exclusive, non-transferable right to access and use the Service solely for internal business purposes during the Term.
Customer may permit its employees and authorized contractors (“Users”) to access the Service, provided they comply with this Agreement. Customer is responsible for all use by its Users.
a. Ownership: Customer retains all rights, title, and interest in Customer Data.
b. Use Rights: Customer grants Provider a limited license to process Customer Data solely for the purpose of providing and improving the Service.
c. Restrictions: Customer shall not upload data subject to special legal protections (e.g., health, biometric, or financial data) unless compliant with all applicable laws.
Each party agrees not to disclose the other party’s Confidential Information without prior written consent, except to employees or advisors who need to know and are bound by confidentiality obligations. Confidentiality obligations survive for three (3) years post-termination.
